New Minimum Wage Effective January 1, 2016

California Minimum Wage…

  • Effective January 1, 2016, the minimum wage in California is $10.00 per hour.
  • Note: Local government can set local wage requirements. For example, the City of Los Angeles has approved a minimum wage of $10.50 effective July 1, 2016. ACRI members are encouraged to contact local city or county governments regarding local wage laws.

Helpful Reminders…

  • Workplace Posting Obligations: The Department of Industrial Relations requires employers to post information related to wages, hours and working conditions in an area frequented by employees. For a list of available safety and health postings, visit www.dir.ca.gov.
  • Rest Periods: Employers are required to allow nonexempt employees to take rest periods, providing the employee works a shift longer than three and one-half hours. Ten minutes of break time for each four hour work period is required.
  • Restrooms: Employers must provide hand washing facilities at or adjacent to toilet facilities. When there are less than five employees, separate toilet rooms for each sex are not required as long as they can lock from the inside. The number of required toilets varies based on the number of employees. For example 1-15 employees require one restroom, 16-35 require two, 36-55 require 3, etc.
  • Overtime Pay: Employees shall not be employed more than 8 hours in any workday or more than 40 hours in any workweek unless they receive 1 ½ times their regular rate for all hours worked over 8 hours in any workday and over 40 hours in the workweek. Eight hours constitutes a day's work, and beyond 8 hours in any workday or more than six days in any workweek is permissible if the employee is compensated at not less than:
    • One and one-half times the employee's regular rate of pay for all hours worked in excess of 8 hours up to and including 12 hours in any workday, and for the 8 eight hours worked on the seventh consecutive day of work in a workweek; and
    • Double the employee's regular rate of pay for all hours worked in excess of 12 hours in any workday and for all hours worked in excess of eight on the seventh consecutive day of work in a workweek.
